Whether it is refundable depends on the reservation agreement: with reputable developers this is now clearly regulated by a new consumer-protection rule (in force since 31 January 2025) — if the developer pulls out or permits are missing, you get your money back. What Is the Reservation Fee for a Pattaya New-Build?

Anyone buying an off-plan or new-build condo in Pattaya encounters the so-called reservation fee right at the start — in English "Reservation Fee" or "Booking Fee", often referred to in the contract as a "Reservation Agreement". It is the first formal step and takes your desired unit off the market. For the duration of the reservation, the developer may not offer that specific unit to anyone else, and the price is locked in for you.

This is a genuine advantage with new-builds in particular: in sought-after projects in Wongamat, Pratumnak or Jomtien, the best floor plans, floors and sea-view positions go quickly. The reservation lets you secure your unit at leisure before anyone else snaps it up — and at an early, attractive price. How High Is the Reservation Fee in Pattaya?

There is no fixed statutory amount — it depends on the developer, project and unit size. In practice the booking fee for Pattaya condos typically falls between 50,000 and 300,000 THB. For a typical studio or one-bedroom apartment, around 100,000 THB is the most common benchmark.

Important: the reservation fee is not an additional cost but a down payment. It is credited in full against the purchase price. You are not paying "extra" — you are making the very first instalment of your regular payment. For conversion purposes I calculate at approximately 38–39 THB per euro. What Does the Reservation Secure — Unit and Price

The reservation agreement fulfils two core functions that should appear in every proper contract:

  • The specific unit — with unit number, floor, building/tower, living area in m² and the exact position in the floor plan. This makes it unambiguous which apartment is yours.
  • The price — the agreed total purchase price is fixed and cannot be increased by the developer during the construction period. In a market with roughly 3–5% appreciation per year, this price lock is worth real money.

This makes buying a new-build pleasantly different from the bidding pressure of some resale transactions: from day one you know exactly what you are getting and what it costs.

Is the Reservation Fee Refundable?

This is the most common question — and the answer is: it depends on what the reservation agreement says and who "pulls out". The principle under Thai law is clearly regulated:

The Legal Background

Under Section 378 of the Thai Civil and Commercial Code, a down payment is treated in case of doubt as a penalty for the event that the buyer withdraws without cause. In simple terms: if you retract your commitment without reason and do not sign the sales contract within the agreed period, the fee may be forfeited. A refund must be expressly provided for in the contract — which is exactly why I read through every reservation agreement with you before you sign.

New Consumer Protection Since 31 January 2025

There is very welcome news here for buyers from German-speaking countries: since 31 January 2025, the sale of condo units via reservations in Thailand is a "contract-controlled business". Developers must use a standardised reservation agreement with legally prescribed mandatory content. This significantly strengthens your position:

  • Full refund if the developer fails to obtain required permits, unilaterally changes specifications, materials or the price, or breaches the contract.
  • Clear repayment deadlines: 15 days for bank transfer, 45 days for credit card payment.
  • Prohibited clauses: liability exclusions for construction delays, shifting the burden of proof onto the buyer, or unilaterally altering terms are no longer permissible.
  • Transparency obligation: two identical contract copies (one for you), accurate project details and permits on file.

Violations can cost the developer up to 200,000 THB in fines or their licence. For you this means: with a vetted, reputable developer — and those are exactly the ones I help you select — your money is better protected today than ever before.

What Is in the Reservation Agreement?

A clean reservation agreement is brief but precise. These are the points I check for you:

  • Buyer and developer details as well as the exact project name.
  • Unit details: unit number, tower, floor, living area, foreign or Thai quota.
  • Total purchase price and the amount of the reservation fee including its credit.
  • Reservation period: typically 14–30 days until the SPA is signed.
  • Payment plan outline: the subsequent instalments through to completion.
  • Refund and withdrawal conditions.

From Booking to Sales Contract (SPA): the Next Steps

The reservation is only the opening move. Here is how things proceed from there:

  1. Reservation: you pay the booking fee and the unit is reserved for you.
  2. Review: during the reservation period I check the project, developer, permits and foreign quota availability on your behalf.
  3. SPA signing: you sign the Sales and Purchase Agreement — the legally binding sales contract with the developer containing the full payment plan. The reservation fee is credited and the first regular down payment (often 20–30%) becomes due.
  4. Instalment payments: according to construction progress or a fixed schedule through to completion.
  5. Handover and title transfer: upon completion — inspection, final payment and title registration at the Land Office.

When buying a new-build directly from a vetted developer, your own lawyer is usually not necessary: SPA contracts are standardised and additionally regulated by law since 2025. Having your own lawyer is most worthwhile primarily when buying resale from a private seller. This is a genuine buyer advantage — lower costs, less bureaucracy.
